The No Longer Last Journey™ Weekly Check-In


By purchasing The No Longer Last Journey™ Weekly Check-In (hereinafter “Weekly Check-In”), you, the purchaser (hereinafter “Member”) enters an agreement with Mia Hemstad LLC (hereinafter "Company") and agree to the following terms:

1. Weekly Check-In Deliverables

Weekly Check-In is an online membership. Company agrees to provide Member:

  1. Weekly live 1-hour online sessions with journaling, live chat, and coaching.*

  2. Replays of sessions, which are emailed to Members shortly after live sessions conclude.

  3. Journal prompts.

*Should Company cancel a Weekly Check-In live session, Company will schedule a make-up session.

2. Access to Weekly Check-In

Member will retain access to Weekly Check-In for as long as Member pays the monthly subscription fee. If Member fails to pay the monthly subscription fee, Company has the right to revoke access to the Weekly Check-In.

3. Forum Policy

Member acknowledges that any violation of the Forum Policy may result in the immediate suspension or termination of their access to Weekly Check-In.

Company strives to maintain a safe community for all our users. In order to preserve our mission, we have developed a set of community guidelines (hereinafter “Guidelines”). We have a zero-tolerance policy for harmful content, and we have the right, in our sole discretion, to remove any content and/or suspend or terminate any Member if we find that violations of our Guidelines have occurred. 

Company will remove any Member who posts content that:

  • Defames, abuses, harasses, stalks, threatens or otherwise violates the legal rights (such as rights of privacy and publicity) of others.

  • Publishes, posts, or disseminates any defamatory, infringing, indecent, misleading or unlawful material or information.

  • Contains any vulgar or obscene language.

  • Nudity or overly sexualized content.

  • Is spamming in nature.

  • Trolling activities (repetitive posting that disrupts regular conversation).

  • Solicits any outside individuals, goods or services.

  • Contains hateful language targeting race/ethnicity, religion, gender, the LGBTQ2IA+ community, nationality, or political beliefs.

  • Violates intellectual property rights, including copyright.

Comments posted by Members of the Weekly Check-In live chat do not represent the opinions of Company. Company is not responsible for fact checking or verifying the accuracy of any content posted in the live chat of the Weekly Check-In. Member relies on the content posted solely at Members’ own risk, and Company is not responsible for any damages or harm caused by relying on such content. 

Any content posted in Weekly Check-In’s live chat is in no way intended as medical advice or as a substitute for medical treatment. As a material condition of this agreement, Member agrees not to use such opinions or information in this manner. Nothing herein is intended to diagnose, treat, or provide a cure for any condition Member may be experiencing. Member must always seek the advice of a physician or other qualified healthcare provider if Member has any questions regarding their mental health, a medical condition, diet, nutritional supplements, an exercise regimen, or any other matter related to Member’s health and well-being. 

4. Disclaimer

Company's Privacy Policy, which can be viewed by clicking on this link, is hereby incorporated by reference into this agreement. Member understands that Company will be providing educational content to Member and that Company’s obligations under this Agreement exist only while Member is a paying member of the Weekly Check-In and that Company’s obligations will cease once Member or Company cancels Member’s payment or payments. Member also understands that Company is not providing one-on-one services on behalf of Member.

5. Assumption of Risk

Member understands that the use of Weekly Check-In is done at Member’s own risk. The information published in the Weekly Check-In is for informational purposes only. Any reliance Member places on such, Member does at Member’s own risk. Member understands that while great care is taken to provide Member with the best information possible, Company makes no representations or warranties of any kind, express or implied, about the reliability, accuracy, completeness, security, or currency of the information provided.

6. Informational Purposes Only

In no way is the information provided meant to be a substitute for medical or psychological advice. This information does not serve to diagnose, treat, or provide a cure for any condition Member may be experiencing. If Member requires medical or psychological services, it is the responsibility of Member to seek out the attention of a licensed doctor or mental health professional.

7. Not Professional Medical Services

Company provides life coaching services. The services Company is providing through Weekly Check-In is not to be construed as medical advice.

8. Company Is Not Providing Professional Healthcare Services

Company does not claim to and will not be held responsible for diagnosing, treating, or curing any physical or mental health condition, nor will Company be prescribing any form of medication. Company’s services do not take the place of healthcare professionals. Under no circumstances should Member stop seeing their team of healthcare professionals. 

If Member decides to take action based on the services Member receives from Company, Member does so at their own risk. Member understands and acknowledges that COMPANY IS NOT PROVIDING PROFESSIONAL HEALTHCARE SERVICES. COMPANY IS NOT SERVING AS A PROFESSIONAL HEALTHCARE PROVIDER.

9. Testimonials

Any testimonials provided on Company’s website www.miahemstad.com and in Weekly Check-In are opinions of those providing them. The information provided in the testimonials is not to be relied upon to predict results in your specific situation. The results you experience will be dependent on many factors including but not limited to your level of personal responsibility, commitment, and abilities, in addition to those factors that Member and/or Company may not be able to anticipate.

10. Payment

In consideration of Member’s access to Weekly Check-In, Member agrees to pay $25.00 per month. Member hereby authorizes Company to charge Member’s credit card or debit card automatically as part of Member’s payment plan.

11. No Refunds

Company does not offer any refunds for Weekly Check-In.

12. Cancellation

Member may cancel their payments at any time. Member acknowledges that if they cancel their payments, they will lose access to Weekly Check-In. Should Member fail to make timely payment, Company may immediately suspend Member’s access to Weekly Check-In. Company may cancel Member’s access to Weekly Check-In at any time for any reason.

13. Intellectual Property

Company owns the rights to all content in Weekly Check-In such as texts in the forms of PDFs, guides, books, classes, videos, explanations and the like, as well as other graphics, logos, images, downloads, and other like materials. Member’s participation in Weekly Check-In does not transfer any intellectual property rights to Member. Company grants Member a single-use, non-exclusive, non-transferable, revocable license to any and all Weekly Check-In content. Member agrees not to create any derivative works of the content found in Weekly Check-In.

14. Force Majeure

Company shall not be liable or responsible to Member, nor be deemed to have defaulted or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of Company including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion, or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, epidemic, pandemic, lock-outs, strikes or other labor disputes (whether or not relating to either party’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

15. Independent Contractor

Nothing in this Agreement shall be construed to create a partnership, joint venture, employment, or agency relationship. Company agrees only to provide Member with access to Weekly Check-In, which provides education and information. The information contained in Weekly Check-In, including any interactions with the coaches, is not intended as, and shall not be understood or construed as, professional advice.

16. Severability

If any provision of this Agreement shall be declared invalid or unenforceable, such provision shall be deemed eliminated from this Agreement, and all remaining provisions shall continue in full force and effect.

17. Liability

Member agrees to absolve and does hereby absolve Company of any and all liability or loss Member may suffer or incur as a result of use of Weekly Check-In and/or any information and resources contained in Weekly Check-In. Member agrees that Company shall not be liable to Member for any type of damages, including direct, indirect, special, incidental, equitable, or consequential loss or damages for use of Weekly Check-In.

18. Warranty

Company makes no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, classes, videos, PDFs, downloads, and related graphics contained in Weekly Check-In for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services, classes, videos, PDFs, downloads, and related graphics are provided “as is” without warranty or condition of any kind. Company and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services, classes, videos, PDFs, downloads, and related graphics including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement.

19. Assignment

Member may not assign this Agreement without express written consent of Company.

20. Modification

Company may modify terms of this Agreement at any time. All modifications shall be posted on the Company’s website.

21. Indemnification

Member agrees to indemnify, defend, and hold harmless Company, its officers, directors, employees, agents, and third parties for any losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) relating to or arising out of Member’s use of or inability to use Weekly Check-In and related services, any user postings made by Member, your violation of any terms of this Agreement or your violation of any rights of a third party, or Member’s violation of any applicable laws, rules or regulations. 

22. Dispute Resolution

Member expressly waives any and all claims, now or in the future, arising out of or relating to Weekly Check-In. To the extent Member attempts to assert any such claim, Member hereby expressly agrees to present such claim only in the small claims courts in Orange, California.
